Terms and conditions

1. SCOPE OF APPLICATION

These General Terms and Conditions for Room Bookings ("GTC") apply to all apartments of NeuFi KLG, as well as to all further services and deliveries provided in this context.

The General Terms and Conditions of the Customer shall not apply.

The GTC are also provided in French and English. In case of discrepancies, the German version shall prevail.

2. CONCLUSION OF CONTRACT

A single reservation is valid without a left guarantee until 15.00 on the day of arrival. With a room guarantee, your reservation remains valid for the whole night even if you arrive after 4:00 pm.
Guarantees for a room reservation are:

- Credit card (Visa, American Express, Mastercard) - TWINT

An offer for group reservations is explicitly designated as such and must be signed by the customer and returned to the apartment provider NeuFi KLG. An offer is valid for 7 days (acceptance period). This means in particular that offers, price lists and the like issued by an apartment provider do not constitute a binding offer.

NeuFi KLG expressly reserves the right to put the rooms back on sale during and after the expiration of the acceptance period for the offer for group reservations. In case of a new request, the new offer may contain deviations from the first offer.

3. SERVICES AND PRICES

The customer does not acquire the right to the provision of certain apartments, but the apartment provider undertakes to provide apartments of the reserved category. If, for unforeseen reasons, an apartment of the same value as reserved is not available upon arrival, accommodation will be provided in an apartment of the next higher category. In the event that no apartment is available, the apartment provider will arrange for at least equivalent accommodation in another hotel. 

The customer is obligated to pay the applicable or agreed upon prices of the apartment provider for the provision of the apartment and the other services used by the customer. This also applies to services and expenses of NeuFi KLG to third parties arranged by the customer.

The prices are in CHF, per room / night, including free W-LAN and VAT. The City Tax per person / night is not included.

4. ROOM HANDOVER AND RETURN

Booked rooms are available to the customer from 15.00 on the agreed day of arrival. The customer has no right to earlier apartment occupancy.

On the agreed departure day, the apartments must be vacated and made available by 10:00 a.m. at the latest. Thereafter, the apartment provider may charge 50% of the full accommodation price (list price) due to the late vacating of the room for its use in excess of the contract until 3:00 p.m., from 3:00 p.m. 100%.

5. PAYMENT

The booking must be paid by the customer immediately so that the reservation is active. Other invoices of the apartment provider without due date are payable within 10 days from receipt of the invoice without deduction. The apartment provider is entitled to call accrued debts at any time and demand immediate payment.

The apartment provider is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer.

If the customer is located abroad, the apartment provider reserves the right to debit the entire invoice amount from the guarantee credit card. Any exchange rate differences or bank charges will be borne by the customer.

The customer can only offset an undisputed or legally binding claim against a claim of the apartment provider.

6. CANCELLATION CONDITIONS

6.1 Cancellation conditions for individual reservations

Individual reservations are normally considered definite when the apartment provider's offer has been confirmed. In case of a short-term cancellation after the cancellation deadline, 100% of the nights may be charged.

However, unless otherwise stated, the following conditions apply to individual reservations:

- Cancellation up to 5 days in advance of the arrival date: no costs - Cancellation 4 days in advance of the arrival date: costs for the entire stay.

6.2 Cancellation conditions for groups

The cancellation conditions for group reservations depend on the group size and are regulated separately. If there are no separate cancellation conditions, the following rules apply:

  • Cancellation up to 60 days before arrival free of charge - Cancellation up to 30 days before arrival 50% of the total expected turnover - Cancellation up to 14 days before arrival 100% of the total expected turnover.

7. CANCELLATION BY NEUFI KLG

If the customer has the right to cancel the contract free of charge according to clause 6 above or separate agreement, the apartment provider is entitled for his part to withdraw from the contract during this period if there are requests from other customers for the contractually booked apartment and the customer does not waive his right to cancel free of charge upon inquiry by the apartment provider.

If an agreed advance payment is not made even after a reasonable grace period set by the apartment provider has expired, NeuFi KLG is also entitled to withdraw from the contract.

Furthermore, the apartment provider is entitled to withdraw from the contract extraordinarily for factually justified reasons, for example in case of

  • force majeure or other circumstances beyond the control of the apartment provider make the fulfillment of the contract impossible 

  • apartments are booked under misleading or false information of material facts, e.g. in the person of the customer or the purpose - the apartment provider has reasonable grounds to believe that the use of the apartment services may jeopardize the smooth operation of the business, the safety or the reputation of the apartment provider in public, without this being attributable to the control or organizational sphere of NeuFi KLG - there is a violation of the above paragraph 5.

In case of a justified withdrawal of the apartment provider, the customer has no claim for damages.

8. BOOKINGS VIA TOUR OPERATORS

In case of bookings through a tour operator, its general terms and conditions apply.

 

9. LIABILITY / DUTY OF CARE

The apartment is to be treated by the customer with the utmost care. The customer or the company must pay for any damage caused. A violation of the house rules can be punished with 500 CHF. The apartment provider declines any liability for theft, etc. and in relation to services provided by third parties. Any further liability is excluded.

11. FINAL PROVISIONS

In addition to the GTC, further provisions and booking conditions may apply, which take precedence over the GTC. Changes or additions to the accepted offer or these GTC should be made in writing. Unilateral changes or additions by the customer are invalid.

Place of performance and payment is the registered office of the apartment provider.

Swiss law applies with the exclusive place of jurisdiction being Zurich.

Should individual provisions of these GTC be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
